Welcome to PhotoJunkyard. By accessing or using our platform, you agree to the following conditions. These rules are in place to ensure a fair, safe, and transparent experience for all users and contributors.

1. General Conditions

1.1. By using PhotoJunkyard, you affirm that you are at least 18 years old or have the consent of a legal guardian.
1.2. Your use of the platform must comply with all applicable laws and regulations.
1.3. PhotoJunkyard reserves the right to update these conditions at any time. Changes will be communicated on the platform or via email.

2. User Responsibilities

2.1. You agree not to upload or download content that:

• Violates intellectual property rights.
• Contains offensive, harmful, or illegal material.
  2.2. You are responsible for maintaining the confidentiality of your account credentials and activities conducted under your account.

3. Contributor Conditions

3.1. Ownership and Licensing: Contributors retain ownership of their uploaded assets but grant PhotoJunkyard a non-exclusive license to display, distribute, and facilitate sales or downloads.
3.2. Compliance: All uploaded content must adhere to intellectual property laws and platform guidelines.
3.3. Responsibility: Contributors are solely responsible for ensuring their content does not infringe on the rights of third parties.

3.4. Licensing Process

• 3.4.1. Licensing is managed through the upload interface. Contributors are required to download a license text file and include it in the .zip file containing the asset they upload.
• 3.4.2. Every uploaded asset undergoes a review process for approval or rejection before being made available on the platform.

4. Payment and Transactions

4.1. Premium content and subscriptions are processed securely through Stripe, Paypal, and Mollie.
4.2. Contributors receive 50% of the sale price for premium assets sold. This percentage may increase based on the volume of assets contributed over time. Contributors can track their earnings and payout history via their dashboard.
4.3. Donations via the "Buy a Coffee" feature are voluntary and non-refundable. This feature allows users to make voluntary donations to contributors as a show of appreciation for their work.
4.4. PhotoJunkyard is not liable for disputes between users and contributors regarding purchased or downloaded content.

5. Limitations on Use

5.1. Users may not redistribute, resell, or sublicense any content downloaded from the platform. All content is licensed for personal or commercial use as specified during the download process.
5.2. Daily and monthly download limits apply as per your subscription plan.
5.3. The free plan is intended for personal use only and may not be exploited for commercial purposes.

6. Prohibited Activities

6.1. Users are strictly prohibited from:

• Uploading infringing or illegal content.
• Circumventing payment systems or download limits.
• Misusing the platform to distribute harmful or malicious software.

7. Intellectual Property

7.1. The PhotoJunkyard platform, including its design, functionality, and branding, is the exclusive property of PhotoJunkyard.
7.2. All uploaded content remains the intellectual property of the contributor. Users are granted a limited, non-exclusive license to use the content as per the terms of purchase.

8. Termination of Access

8.1. PhotoJunkyard reserves the right to suspend or terminate accounts for violations of these conditions.
8.2. Users whose accounts are terminated for violations may lose access to previously purchased content.

9. Limitation of Liability

9.1. PhotoJunkyard is not liable for damages resulting from the use of content obtained through the platform.
9.2. Users and contributors agree to indemnify PhotoJunkyard against any claims arising from their actions or content.

10. Governing Law

10.1. These conditions are governed by the laws of "The Netherlands."
10.2. Any disputes will be resolved in accordance with these laws.
